Text Opt-In Terms and Conditions
These terms and conditions ("Terms") govern your participation in the text opt-in service ("Service") provided by Hearts of Empowerment ("we" or "us"). By opting in to the Service, you agree to be bound by these Terms. Please read them carefully.
1. Eligibility: To participate in the Service, you must be at least 18 years old or have the consent of a parent or legal guardian. The Service is available only to individuals who have a mobile device capable of sending and receiving text messages.
2. Opt-In Process: To opt in to the Service, you must provide your consent by texting the designated keyword or short code to the specified number. Standard text message and data rates may apply. By opting in, you consent to receive text messages from us related to the Service.
3. Service Description: The Service allows you to receive periodic text messages containing updates, promotions, offers, or other information related to our products, services, or events. The frequency of messages may vary and will be determined by us.
4. Opt-Out Process: You may opt out of the Service at any time by texting the designated keyword or short code to the specified number or by following the instructions provided in the text message. Upon receipt of your opt-out request, we will cease sending text messages to your mobile number, except for any confirmation messages related to your opt-out request.
5. Privacy and Data Usage: We respect your privacy and will handle your personal information in accordance with our Privacy Policy. By participating in the Service, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
6. Message and Data Rates: Standard text message and data rates may apply to messages sent or received through the Service. You are responsible for any charges incurred from your mobile service provider.
7. Modification or Termination: We reserve the right to modify, suspend, or terminate the Service or these Terms at any time, for any reason, without prior notice. We may also modify the frequency or content of text messages sent through the Service. We will not be liable to you or any third party for any such modifications, suspensions, or terminations.
8. Disclaimer of Warranty: The Service is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the Service, including but not limited to its accuracy, reliability, or availability. We disclaim all warranties, express or implied, to the fullest extent permitted by applicable law.
9. Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
10. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Virginia. Any disputes arising out of or in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the courts of Virginia.
By opting in to the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
